A significant body of literature links psychopathy and psychopathic personality traits with criminal behavior and involvement with the criminal justice system. However, very little research has examined whether psychopathic personality traits are related to being a successful criminal (e.g., evading detection). This study addresses this gap in the literature by examining whether psychopathic personality traits are associated with the likelihood of being processed by the criminal justice system (i. ...

Abstract For over 200 years, Western courts have considered pleas of “not guilty by reason of insanity” (NGRI) for defendants in possession of a mental defect rendering them unable to understand the wrongfulness of their act. Until recently, determining the mental state of a defendant has fallen largely upon the shoulders of court psychologists and experts in psychiatry for qualitative assessments related to NGRI pleas and mitigation at sentencing. However, advances in neuroscience—particularly neurological ...

Abstract This paper focuses on the consequences for providers of working with survivors of traumatic events, particularly criminal victimization. The paper reviews the relevant research and treatment literature associated with secondary traumatic stress (STS) and related variables (burnout, compassion fatigue, vicarious trauma, and countertransference). The latter part of the paper identifies the most important mitigating factors in the development of STS. These include good training specific to trauma ...

Twin studies can be used to investigate the contributions of genetic factors, the common or shared environment, and the unique or non-shared environment to individual differences in a measurable characteristic. This paper reports the results of preliminary analyses of self-reported data on arrests and criminal behaviour from the Vietnam Era Veteran Twin Registry. The subjects for the study were 3226 male twin pairs in which both members served in the military during the Vietnam era. There were significant ...

Since its formal introduction into psychiatric nomenclature more than a decade ago, the diagnosis of posttraumatic stress disorder (PTSD) has become firmly entrenched in the legal landscape. In part, this is because PTSD seems easy to understand. It is one of only a few mental disorders for which the psychiatric Diagnostic and Statistical Manual (DSM) describes a known cause. Since the diagnosis is usually based on patients' self-report, however, it creates the possibility of distortion aimed at avoidance ...

Numerous lines of evidence have conclusively established the role of sugars in caries etiology and the importance of sugars as the principal dietary substrate that drives the caries process has not been scientifically challenged. While sugars appear to differ little in acidogenic potential, sucrose has been given special importance, as the sole substrate for synthesis of extracellular glucans. Water-insoluble glucans might enhance accumulation of mutans streptococci on smooth tooth surfaces and ...

Studies addressing the relationship between neurotransmitter functioning and violent crime are reviewed. A rich literature exists to support the notion that monoamine (i.e., serotonin, dopamine, and norepinephrine) neurotransmitter functioning is related to human aggressive behaviour. Results from these studies provide, at best, indirect evidence that neurotransmitter abnormalities are involved in violent criminal behavior. Few studies have specifically addressed the role of neurotransmitter functioning ...

Abstract The life‐long neurological impairments found in people with fetal alcohol spectrum disorders (FASDs), including learning disabilities, impulsivity, hyperactivity, social ineptness, and poor judgment, can increase susceptibility to victimization and involvement in the criminal justice system (CJS). Individuals with FASDs become involved in the CJS as complainants, witnesses, and accused. Their disabilities, resulting from the prenatal alcohol exposure, must be considered at all stages in the ...

This is the first overview to be published of the whole field of forensic mycology. It is based on all available information located in the literature, together with 13 examples from recent casework. Background information on fungi is given, and this is followed by an outline of the value, and potentially wide application, of mycology in criminal investigation. Applications include roles in: providing trace evidence; estimating time since death (post-mortem interval); ascertaining time of deposition; ...

The role of diet in anti-social behaviour was considered, paying particular attention to double-blind placebo-controlled trials. Meta-analysis of five well-designed studies found that elimination diets reduced hyperactivity-related symptoms, producing a summary standardized mean difference (SSMD) of 0.80 (95% CI 0.41–1.19). The picture was of children potentially responding to a wide range of food items although the pattern was individual to the child. Supplementation with poly-unsaturated fatty acids ...

Some believe that genetics threatens privacy and autonomy and will eviscerate the concept of human nature. Despite the astonishing research advances, however, none of these dire predictions and no radical transformation of the law have occurred. Advocates have tried to use genetic evidence to affect judgments of criminal responsibility. At present, however genetic research can provide little aid to assessments of criminal responsibility and it does not suggest a radical critique of responsibility.

In the German-speaking area, recent years have seen a rapid growth of the need for forensic age estimations. Such need arises, for example, if no verified information on the age of a person suspected of a criminal offence is available; the issue at question in terms of criminal law is whether the person concerned has reached the age of criminal responsibility and whether general criminal law in force for adults is to be applied. The relevant age tresholds in criminal proceedings are 14, 18 and 21 ...

The neurobiological basis of violence and criminal behaviour is increasingly being recognized. Glenn and Raine review recent 'neurocriminology' studies and discuss whether and how this emerging field may influence the punishment, prediction and prevention of criminal behaviour. Criminal behaviour and violence are increasingly viewed as worldwide public health problems. A growing body of knowledge shows that criminal behaviour has a neurobiological basis, and this has intensified judicial interest ...

Scientific explanations of behavior involve a specification of both antecedent events or initial conditions and general laws that describe how each situation causes the succeeding one. Thus, laws acting on the current state of a system endlessly produce new states (Simon, 1992). To logical positivists, explanations are deductions about particular phenomena made from universal laws. Thus, in a formal sense, predictions and explanations differ only in that, in the former, future events instead of past ...

The past several years have seen a surge of interest in using risk assessment in criminal sentencing, both to reduce recidivism by incapacitating or treating high-risk offenders and to reduce prison populations by diverting low-risk offenders from prison. We begin by sketching jurisprudential theories of sentencing, distinguishing those that rely on risk assessment from those that preclude it. We then characterize and illustrate the varying roles that risk assessment may play in the sentencing process. ...

This article examines mental illness among adult, juvenile, male, female, jail, and prison inmates. It also explores the way in which mental health diagnoses impact offending and violent behavior. A review of literature pertaining to differences between the genders and age of offenders suggests that psychiatric disorders are more common among criminal offenders than the population at large. Furthermore, it appears that many mentally ill offenders do not receive sufficient treatment during their ...

Children whose parents exhibit criminal behavior (CB) appear to have an increased risk of displaying CB themselves. We conducted a systematic review and pooled results from 23 samples in 25 publications (including 3,423,483 children) in this meta-analysis of intergenerational transmission of CB. On average, children with criminal parents were at significantly higher risk for CB compared with children without criminal parents (pooled OR = 2.4). Studies taking into account covariates also showed increased ...

Halfway houses are a form of community supervision and correctional programming that have become a staple intervention in recent years. Despite the ingrained belief in their benefits with respect to successful reintegration, this assumption may not be justified based on the existing literature. The current study provides a systematic review and meta-analysis of nine studies examining the effects of halfway houses on recidivism. Overall, the findings suggest that halfway houses are an effective correctional ...
