If they do ot, Mr Scargill may be denied the vital support he would need to meet the challenge of Mr Robert Maxwell, publisher of the Daily Mirror, which made the allegations, and sue for libel. Without it, Mr Scargill would be faced with the prospect of mounting a hugely expensive action from his own funds. A union cannot sue for libel but Mr Scargill could mount a personal action with union backing. Because of the complexity of the allegations, such an action could last for months and involve huge costs.
