McIvor v Canada and the 2010 Amendments to the Indian Act: A Half-Hearted Remedy to Historical Injustice

ResumoThis paper explains the background to the 2010 case of McIvor v. Canada and the amendments to the Indian Act that resulted from this case. Despite being amended in the mid-1980s to address the Act’s gender bias, McIvor found that some gender bias in the Act remained. McIvor is yet another case in the struggle of Canada’s Indigenous women to gain equal rights, particularly when it comes to the inheritance and permanence of Indian Status. The ultimate amendments to the federal Indian Act prompted by McIvor do not, as this paper argues, offer the comprehensive redress that the plaintiffs in McIvor sought.
