Brazilian Legal Issues

The paper intends to diagnose the challenges faced by the concept of Liberal State of Law in view of the so called “new” social movements which point out to structural problems of that model of state. Therefore, it tries to determinate the role of these social actors that demand the return of an autonomous space for the “politician” in the modern liberal community. The analyses presented by J. J. Rousseau and Carl Schmitt are the theoretical support used, as far as they show potentially fertile arguments in their diagnoses about the growing contradictions that mark the existence of the modern state.
