Trabalho recebido e avaliado pelo Conselho executivo da Revista Quaestio Iuris Resumo O MERCOSUL e uma das mais ambiciosas acoes da politica externa brasileira – PEB. Ele representa uma opcao compartilhada de desenvolvimento e rascunha um legitimo processo comunitario. Inobstante, as crises intermitentes entre os dois principais parceiros, Brasil e Argentina, e as dificuldades de transicao de uma uniao aduaneira incompleta para um mercado comum impoe a seguinte reflexao: tal como constituido o MERCOSUL e o melhor caminho para a consecucao dos mais elevados ideais da PEB? A partir deste fator-problema, e considerando os 10 anos de vigencia do Protocolo de Ouro Preto, o presente paper visa a contemplar dois objetivos: verificar se a estrutura juridico-institucional do MERCOSUL vem sendo eficaz para a promocao de um verdadeiro mercado comum; e verificar em que o a cordo decorrente do Tratado de Assuncao concorre para a consecucao dos propositos estrategicos do Brasil hoje. Cetico face ao exito dos objetivos supra, em consideracoes finais propoe-se que a PEB deve ampliar os lacos juridicos e politicos com outros paises, em especial das Americas do Sul e Central, e tentar converter o MERCOSUL em uma zona de livre comercio. Palavras-chave Mercosul – cooperacao internacional – politica externa Abst r act The MERCOSUL is one of the most ambitious actions of the Brazilian Foreign Policy – PEB. It represents a sharing option of development and jot down a genuine communitarian processes. However, the continuous crises between the two majors partners, Brazil and Argentina, and the difficulties in the transition of a n incomplete Customs union to a common market introduce one necessary reflection: in this actual shape, is MERCOSUL the best way to improve the PEB? Under this reflection, and considering the 10th birthday of the Ouro Preto Protocol, the present paper intents to realize two objectives: verify if the juridica l and institutional structure of MERCOSUL is being efficient in the promotion of a real common market; and verify if MERCOSUL is an efficient way to realize today Brazilian strategic aims. Unbelieving the success of the objectives above, in final considerations this paper proposes that the PEB have to increase the links with others countries, especially with South and Central America n ones, and try to convert the MERCOSUL in a free trade zone .
