O presente artigo discorre sobre o maior alcance da atuacao do Judiciario, em paralelo com a atual crise de legitimidade do Poder Legislativo. Nesse contexto, sera analisado o fenomeno da judicializacao, vinculado diretamente ao maior numero de questoes de larga repercussao politica ou social que passaram a ser decididas por orgaos do Poder Judiciario. Outro conceito importante analisado e a ideia de ativismo judicial, que esta associada a uma participacao mais ampla e intensa do Judiciario na concretizacao dos valores e fins constitucionais, com maior interferencia no espaco de atuacao dos outros dois Poderes. JUDICIALIZATION, JUDICIAL ACTIVISM AND DEMOCRATIC LEGITIMACY This essay aims to discuss the more comprehensive range of action taken by the judiciary branch, in relation to the current crisis of legitimacy that the legislative branch has been going through. The article focus mainly on two phenomena: “judicialization”, which is connected to the growing number of questions with great political or social repercussion that have been submitted to the judiciary; and judicial activism, which is associated to a more intense and wide judicial participation in the concretion of constitutional ends and values, with a greater interference on areas typically reserved to the other branches.
