Resumo

O presente artigo e fruto de pesquisa iniciada no ano de 2010 e enecerrada em 2011, com ciamento do PIBIC / CNPq, que teve por objetivo principal investigar se os direitos fundamentais dos idosos que vivem na cidade de Sao Luis do Maranhao estavam sendo devidamente tutelados pelo Ministerio Publico Estadual, haja vista a existencia de mecanismo bastante eficaz para tanto, a saber: a acao civil publica. Como hipotese, estipulou-se que a correta utilizacao desse instrumento judicial por parte da Instituicao mencionada acima possibilitaria a tutela adequada dos direitos dos idosos desta capital. Os resultados obtidos vieram a confirmar a hipotese acima mencionada. Palavras-chave: Populacao idosa. Ministerio Publico Estadual. Acao civil publica. THE PUBLIC CIVIL ACTION AS INSTRUMENT USED FOR THE PUBLIC PROSECUTION SERVICE OF MARANHAO STATE IN THE PROTECTION OF THE BASIC RIGHTS OF THE AGED PEOPLE: analysis of the performance of the Public prosecutor's office of Justice Specialized in the Defense of the Rights of the Elderly of the city of Sao Luis from 2003 to 2009 Abstract: The present article is the result of a research initiated in the year of 2010 and finished in 2011, with financial help of PIBIC/CNPq, which had for main objective to investigate whether the basic rights of the aged people who live in the city of Sao Luis were being duly tutored by the State Public Prosecution service, considering the existence of sufficiently efficient mechanism for this, which is: the public civil action. As hypothesis, it was stipulated that the correct use of this judicial instrument as part of the Public Prosecution service of the State of Maranhao would make possible the adequate guardianship of the rights of the aged people of that capital. LA ACCION CIVIL PUBLICA COMO HERRAMIENTA UTILIZADA POR EL MINISTERIO PUBLICO DEL ESTADO DE MARANHAO EN LA PROTECCION DE LOS DERECHOS FUNDAMENTALES DE LOS ANCIANOS: analisis de las acciones de la oficina del fiscal especializado en la defensa de los derechos de los ancianos en la ciudad de Sao Luis desde 2003 hasta 2009 Resumen: Este articulo es el resultado de una investigacion iniciada en 2010 y cerro en 2011 con fondos de PIBIC / CNPq, que tuvo como objetivo investigar si los derechos basicos de los ancianos que viven en la ciudad de Sao Luis do Maranhao estaban siendo adecuadamente protegidos por el Ministerio Publico del Estado, dada la existencia de un mecanismo muy eficaz para esto, a saber, la accion civil publica. Como hipotesis, se estipulo que el uso correcto de este instrumento por la institucion judicial se menciono anteriormente que permitiria la adecuada proteccion de los derechos de los ancianos en esta capital. Los resultados vinieron a confirmar la hipotesis antes mencionada. Palabras clave: Poblacion de edad avanzada. Ministerio Publico. Accion civil publica.
