Resumo O presente artigo parte da analise do texto constitucional, tecendo algumas consideracoes sobre cidadania e dignidade da pessoa humana, fundamentos da Republica Federativa do Brasil. O prisma constitucional permanece como foco central na abordagem dos direitos fundamentais, destacando-se a divergencia doutrinaria estabelecida no estudo do tema. Inaugurando uma vertente mais pratica do assunto, discorre-se sobre os instrumentos juridicos de eficacia dos direitos sociais, retratando-se ao final a atuacao do Ministerio das Cidades no implemento de uma politica publica de habitacao. The constitutional approach remains as the central issue of fundamental rights. Starting a more practical view, some legal instruments of enforcement of social rights are shown. It describes at the end the activities of the Brazilian Ministry of the Cities in order to improve popular housing conditions.
