O presente trabalho objetiva discutir e aclarar a conduta do cirurgiao-dentista diante da requisicao do prontuario odontologico pelo paciente que se entende titular do mesmo. Tal assunto apesar de frequentemente discutido nao encontra ainda um suporte fatico e juridico capaz de dar tranquilidade ao profissional, pois, entregando o prontuario ao paciente, fica completamente sem respaldo documental seja para a continuidade do tratamento ou para provar, em eventual demanda juridica, que realizou tratamento e que o mesmo era o mais indicado. Nao entregando o prontuario ve-se o cirurgiao-dentista em situacao particularmente constrangedora e desagradavel junto ao seu paciente. Neste sentido, e chegado o momento de discutirmos a titularidade do prontuario, ate mesmo no que tange o direito real de propriedade que o cirurgiao-dentista tem sobre seu trabalho intelectual registrado no prontuario. TITLE Dentistry’s promptuary and the scientific property’s right ABSTRACT The purpose of this work was to discuss and clarify the dentist’s ethics facing the demand of odontologic records by the patient who claims its ownership. This subject, though often discussed still has not found forensic support capable of reassuring the dental professional about his rights, once handing, such records to the patient unables him of documentary support during the treatment and it does not provide him with the necessary information about the treatment if forensic prosecution may occur. On the other hand, not handing the records to the patient, causes uncomfortable and disagreeable situations when professional X patient relationship is concerned. So, this is the moment to discuss the records ownership and also the dentist’s real right of of property over such records. Indexing terms: forensic dentistry; records; ethics ownership.
