Discute a cobrança de pedágio sem a existência de via pública alternativa; analisa a natureza jurídica de tal cobrança: taxa ou preço público; e, sob a luz da constituição, discute se a exigência de pedágio em rodovias, sem que haja trajeto alternativo gratuito, interfere no direito de ir e vir. Discusses the toll without the existence of alternative public road; examines the legal nature of this charge: rate or public price; and, under the light of constitution, discusses if the requirement of tolls in highways, without alternative free road, interferes in the right of come and go.
