Resumo

Th is research paper aims to outline the democracy in contemporary society, as well as contextualizing the state system forward to innovations in the globalized world. On this track, is analyzed through a critical approach, using the literature review, the State’s actions through public policies, in particular the resolution nº 125 of the Conselho Nacional de Justiça, a public policy that establishes appropriate treatment the confl ict. Th us, it is consolidated as presents consensual mechanisms such as mediation and conciliation, not using such tools as mechanisms to relieve the court system, but contributing to the construction of a new paradigm of systems for consensus and social peace and in order to address the confl ict and strengthening participatory democracy.
