ResumoThe article was retracted at the request of the editors with an explanatory retraction notice in March 2011. This first version of the retraction was replaced in October 2011 by the below corrected version: “This article has been retracted: please see Elsevier Policy on Article Withdrawal ( http://www.elsevier.com/locate/withdrawalpolicy ). This article has been retracted at the request of the editors as some of the findings have previously been published in Palomero et al. (2007) Osas, El comportamiento de las osas y sus crias en la Cordillera Cantabrica, Fundacion Oso Pardo. Fundacion Oso Pardo (FOP) and Fundacion Biodiversidad (153 pp. +DVD. ISBN 978-84-612-1173-9) without proper cross-referencing. Re-use of any data should be appropriately cited. The scientific community takes a very strong view on this matter and apologies are offered to readers of the journal that this was not detected during the submission process.” Following legal action taken by Dr Miguel Delibes, who objected to the retraction, the Sevilla Court of Appeals requires us to publish the following paragraph -contained in its ruling of October 9th 2017- in relation to the first version of the retraction which was corrected in October 2011: “Declaramos que la demandada ELSEVIER LIMITED ha llevado a cabo una intromision ilegitima en el derecho al honor de MIGUEL DELIBES DE CASTRO a traves de la inveraz y no contrastada nota explicativa en la que se decia que “LOS AUTORES SE HAN APROPIADO DE DATOS AJENOS, HAN PLAGIADO Y HAN OCULTADO LA AUTORIA DE UN TRABAJO PREVIO “que se acompanaba a la superposicion de una banda roja con la palabra “RETRACTED” sobre el articulo “Evidence of sexually selected infanticide in Brown bears in the Cantabrian Mountains” publicado en la edicion ”on line “ en diciembre de 2009 y de forma definitiva en el volumen de febrero de 2010, y que se mantuvo en la edicion digital entre los meses de marzo y octubre de 2011.” The Court ruling was provided in Spanish. We have provided below a direct English translation of that ruling in order to assist readers, but the Spanish version is the authoritative one. “We declare that the defendant ELSEVIER LIMITED carried out an illegitimate interference in the right to honour of MIGUEL DELIBES DE CASTRO through the untruthful and unverified explanatory note in which it was stated that “THE AUTHORS HAVE MISAPPROPRIATED DATA, PLAGIARISED AND CONCEALED THE AUTHORSHIP OF WORK THAT HAD ALREADY APPEARED” that was attached, with a red watermark with the word “RETRACTED” over the article “Evidence of sexually selected infanticide in Brown bears in the Cantabrian Mountains, which article was published in the online edition in December 2009 and permanently in the volume of February 2010, and which retraction notice was maintained in the digital edition between the months of March and October 2011.”
