ResumoThis study aims to demonstrate the possibility of the defense of diffuse and collective rights by the exercise of municipal police power regardless of the Judiciary intervention, describing himself briefly the assigned constitutional authority the municipalities in the legislative and administrative field, addressing the power of the characteristics of police and its use at the municipal level as defense instrument of diffuse and collective rights, especially the right to collective transport insurance and the right to regular occupation of urban land.
