Este ensaio pretende apresentar ao leitor as bases de um dos fundamentos da Teoria Constitucional do Direito Animal. A discussao parte da analise do conceito de dignidade, pensada sob o vies racionalista de Immanuel Kant que entende possuir apenas o ser humano tal atributo. Busca-se ampliar este conceito a partir da analise da teoria de Hans Jonas e Tom Regan, que visa ao estabelecimento de relacao de respeito entre as especies, considerando capazes de dignidade tambem os animais nao humanos. Apos a tentativa de extensao deste valor intrinseco aos animais, parte-se para o estudo dos fundamentos eticos e filosoficos desta abordagem, demonstrando como a concepcao de Kant influenciou as constituicoes modernas. Por fim, demonstrar-se-a que a Constituicao da Republica Federativa do Brasil de 1988 acolhe a tese do Direito Animal Constitucional ao proibir qualquer forma de crueldade para com os animais, sendo necessaria para a garantia deste mandamento mudanca de cunho interpretativo que vise a entender como objetivo estatal o estabelecimento de uma dignidade animal, quaisquer formas de retrocesso.This test is intended to present the reader a basis for a plea of Constitutional Theory of Animal Rights. The discussion part of the analysis of the concept of dignity, under the bias rationalist thought of Immanuel Kant that attaches only to be the concept of human dignity. Search to expand this concept from the theory of Hans Jonas and Tom Regan to demonstrate a new concept of dignity established through the relationship of respect between species. After this attempt to extend an intrinsic value to animals, it is to study the ethical and philosophical foundations of this approach, showing how the design of Kant has influenced the modern constitutions. Finally, it will demonstrate that the Brazilian Constitution of the Republic of hosting the 1988 thesis of a Constitutional Rights on Animal prohibit any form of cruelty to animals, being necessary to ensure a change of this commandment interpretative stamp seeking to understand how State goal the establishment of an animal dignity, prohibiting any form of backlash.
