Portuguese Abstract: O novo Codigo Civil conferiu um novo prisma as relacoes obrigacionais a partir da consagracao dos principios da operabilidade, socialidade e eticidade. Diante desse quadro, a tutela da confianca a cada dia tem se erigido em elemento essencial para a satisfacao das legitimas expectativas criadas nas fases pre e pos-contratual. Com o escopo de reforcar os vinculos e a relacao de confianca estabelecida, o novo Codigo Civil agregou maior precisao no tratamento dos institutos das arras e clausula penal. O legislador, atento a complexidade das relacoes sociais, conferiu poderes mais incisivos aos magistrados para aferir as condicoes em que estipuladas as clausulas penas e as arras, sem, no entanto, tolher a esfera criativa da autonomia privada no desenvolvimento dos dois institutos.English Abstract: The new Brazilian Civil Code gave a new conception to the obligational relationships by the the principles of operability, socialbility and ethic values. Given this situation, the protection of confidence each day has been erected on an essential element for meeting the legitimate expectations created in the pre-and post-contractual. With the scope to strengthen ties and trust established, the new Civil Code has added greater precision in the treatment of the institutes of the sign and penalty. The legislature, aware of the complexity of social relations, more incisive powers given to magistrates to assess the conditions under which the clauses stipulated penalties and the earnest, without, however, hinder the creative sphere of private autonomy in the development of the two institutes.
