Resumo

Contrasta a tecnica empregada pelas autoridades reguladoras do mercado de correspondentes com a pratica contratual estabelecida nesse mercado pelas instituicoes autorizadas a funcionar pelo Banco Central do Brasil (BCB). Conclui que o efetivo alcance dos objetivos da regulacao mostra-se dependente do comportamento dos correspondentes, fato que revela a importância do contrato que esses celebram com as instituicoes autorizadas pelo BCB. Por sua vez, o contrato de correspondente sofre forte influencia dos textos normativos da regulacao sobre o setor, principalmente das normas que impoem clausulas obrigatorias e explicitam o regime de responsabilizacao por infracoes administrativas. Essa dependencia reciproca sinaliza a necessidade de as autoridades atentarem para os efeitos da regulacao sobre os contratos de correspondente sempre que buscarem aprimorar o cumprimento de objetivos regulatorios.Contrasts the regulatory technique employed by the authorities responsible for the regulation of the correspondents’ services with the contractual practice established by the market participants. Concludes, on the one hand, that the achievement of the regulation’s objectives depends substantially upon the behaviour of the correspondents, a fact that points up the importance of the agreements that the latter celebrate with the institutions authorised by the Central Bank of Brazil. On the other hand, it notices that the correspondent agreement is strongly influenced by the regulation of the market, mainly by the rules that impose mandatory clauses and by the liability regime for administrative infractions. Such reciprocal dependence reveals that, in order to improve the accomplishment of regulatory objectives, the authorities shall be aware of the effects of the regulation on correspondent agreements.
