Demonstrar-se-a que o sistema brasileiro ja acolhe a teoria atraves do decreto no 24.645/34, o qual elege como representante dos animais o Ministerio Publico e as Sociedades Protetoras dos Animais.This essay intends to introduce the reader a recurring debate in courts around the world. Animals can go to court to claim their rights? It will demonstrate that the Brazilian system already hosts the theory by decree no 24.645/34, which elects as the representative of the prosecutor animals and the Animal Protection Society.
