O Artigo propoe uma analise das tres obras legislativas de Alfonso X, Fuero, Real, Especulo e Siete Partidas. Levando em conta o debate historiografico em torno da realeza, do direito medieval e das obras juridicas alfonsinas, identificamos, na representacao do rei como vigario de Deus nos codigos de Alfonso X, uma afirmacao da concepcao da realeza centrada na lei. Ao ser cabeca do corpo politico, o monarca e apresentado na legislacao alfonsina ao mesmo tempo como juiz e legislador supremo. No entanto, concebido como persona publica, um rei deve proceder como tal, colocando em primeiro lugar o bem do reino, e nao da sua vontade pessoal que, ao contrario, nao deixa de estar sujeito a lei divina ou a lei natural. Na sua obra legislativa Alfonso X tenta articular o monopolio legislativo monarquico advindo das obras do direito romano classico com a ordem juridico medieval, na qual a intervencao da vontade do principe poderia acontecer so em casos excepcionais. Some reflections around the legal works of Alfonso X Abstract: In this paper, we propose to analyze three corpus juris belonging to Alfonso X: Fuero Real ,Especulo and Siete Partidas. Taking into consideration the historiographical debate about the royalty, medieval law and legislative proceedings of Alfonso X, we noticed that based in the idea of the monarch as a vicar of God, in the works of the King is present the assertion of the concept of the royal power as based on the law. Being the head of the politic body, the monarch embodies both the judicial and legislative branches. Adopted as a persona publica, the king must not go beyond the res publica and must act putting in first place the good of the kingdom, and not their own personal desires and interests, which, in turn, have to obey to the divine laws and the laws of the nature. In the legislative works, Alfonso effort to articulate monarchic legislative monopoly ascending of the works of classical Roman law with medieval legal order, in which the intervention of the Prince could only occur in exceptional cases.
