Este texto trata da possibilidade do reconhecimento da eficacia positiva das normas programaticas, tese tradicionalmente rejeitada. Porem, entende-se cabivel que estas normas produzam eficacia positiva e isto ja vem mesmo ocorrendo, o que demanda uma revisao doutrinaria. Palavras-chave : Norma programatica; eficacia juridica; eficacia positiva. Abstract : This text deals with the possibility of the recognition that effectiveness of programmatic norms can be positive, which is a theory that is traditionally rejected. However, I understand that it is possible that these norms can have positive effectiveness, and that this is actually already happening, what we need is a revision of our current way of thinking on this subject.
