ResumoThis paper is based on the A.'s doctoral dissertation intitled Right to infancy : Mario de Andrade and the playground for children of worker families at the City of Sao Paulo. It analyzes the creation of the first playgrounds as non-formal educational project for city children from 3 to 12 years old. The article describes the origins of the public municipal network of childhood education which was at the time pioneering in guaranteing the right to infancy, in assuring the right to play and creation of infantile culture of preschool children from 3 to 6 years old as well as those of 7 to 12 years old who attended the playgrounds in an alternate schedule to that of the then elementary school. The poet Mario de Andrade, director and idealizor of the Department of culture of City of Sao Paulo in 1935, among the several programs proposed for the worker class, comtemplated the small children, who were educated in contact with nature and with Brazilian culture and folklore
