ResumoThis paper aims to analyze how the rhetorical thinking influenced the understanding and development of the Brazilian civil procedure from some conceptual contributions made by Tércio Sampaio Ferraz Junior. For this, we will make an analysis of the dialogical nature of the process, the modern notion of contradictory as influence, the relativization of the idea of truth in the process and the presence of the duty to state reasons for decisions in order to constitute a binding element and control of a supervening discussion. The reasons for the decision provides participants discussing the indications for their behavior, since it is the only part of the reasoning of the judge who can concretely analyze as nothing that happens in the mind of the judge is directly knowable. The judge has to state the reasons to allow that observer (parties, lawyers, other judges, public opinion) to check that the decision is logical and legally founded.
