Resumo: O artigo objetiva refletir sobre as deficiencias democraticas apontadas na formacao e nos julgamentos do Conselho Nacional de Politica Fazendaria. O CONFAZ foi criado em 1975 para harmonizar as regras do tributo de competencia estadual e conter a migracao de investimentos. A Arguicao de Descumprimento de Preceito Fundamental no. 198 no STF questiona o quorum de votacao (unanimidade) para aprovacao dos beneficios e incentivos. A reflexao se estrutura na analise da concepcao democratica de Robert Dahl, Karl Lowenstein e Luigi Ferrajoli bem como na teoria dos jogos para solucionar os conflitos federativos. As deficiencias democraticas poderiam ser mitigadas com a introducao de quorum majoritario para aprovacao dos beneficios fiscais, bem como que a composicao contivesse representantes da sociedade civil, direta ou indiretamente. Alem disso, a decisao acerca dos beneficios e incentivos deveria observar a metodologia da teoria dos jogos, estabelecendo ambiente cooperativo em detrimento da competitividade entre os entes federativos. Abstract: The paper aims to reflect about the democratic deficits identified at the composition and judgments of the National Council of Finance Policy (Confaz). The Council was founded in 1975 in order to balance the rules regarding this tax and to restrain the investment migration from one state to another. Among CONFAZ’s terms contested on the ADPF no 198 (Motion of Noncompliance of Fundamental Precept) suited at Brazilian Supreme Court, are those regarding the voting quorum (unanimity) for approval of benefits and tax. Democratic conceptions of Robert Dahl, Karl Lowenstein and Luigi Ferrajoli are used as instruments to the analysis. The democratic deficiencies may be mitigated by the introduction of the majority quorum for tax incentive’s approvals and on the introduction of civilian and legislative branch representatives. Furthermore, the forms of decision-making should observe the “Games Theory” in order to stablish a cooperative environment rather than the currently competitive atmosphere.
