Comparative constitutional jurisprudence studies

This article provides a comprehensive study of the works of Francisco de Vitoria in order to indicate the intermediate position of the author between voluntarism and intellectualism, as well as, highlight the originality of his thought. Especially, the importance of Vitoria in the conceptualization of subjective Right and, consequentially, in the genesis of what would later be known as Human Rights.
