EnglishThe article discusses the importance of the study of industrial design, as well as to differentiate the concept of this concept of utility model. The aim of this make a comparative study, with Brazil, on how other countries deal with industrial design in their legislation. In addition, this research seeks to demonstrate the utility of the industrial design to the market competitiveness of small and large companies. Therefore, there was use of websites, magazines, data from regulatory agencies, such as the National Institute of Industrial Property (INPI) and the World Trade Organization (WTO). It was concluded that it is urgent the subject of study for which seek improvements in legislation, so that it becomes more responsive to the needs of this legal protection. Moreover, it was found that the industrial design is one of the main factors that determine whether or not a product will have competitive potential. portuguesEste trabalho visa discutir sobre a importância do estudo sobre o desenho industrial, bem como diferenciar o conceito deste do conceito de modelo de utilidade. Pretende-se com este fazer um estudo comparativo, com o Brasil, sobre como outros paises tratam do desenho industrial em suas legislacoes. Alem disso, esta pesquisa busca demonstrar a utilidade do desenho industrial para a competitividade de mercado das pequenas e grandes empresas. Para tanto, fez-se uso de sites, revistas, dados de orgaos reguladores, como por exemplo, o Instituto Nacional da Propriedade Industrial (INPI) e a Organizacao Mundial do Comercio (OMC). Concluiu-se que e urgente o estudo do tema para que se busquem melhorias na legislacao, de modo que esta se torne mais atenta as necessidades desta protecao legal. Ademais, constatou-se que o desenho industrial e um dos principais fatores que determinam se um produto tera ou nao potencial competitivo.
