Portuguese Abstract: A Historia Constitucional permite atestar o modo como o peso da historia politica e cultural de cada Estado influencia decisivamente o desenho do seu ordenamento juridico-constitucional. Nesta esteira, proponho-me discorrer, por um lado, sobre o relevante papel que as contingencias historicas tiveram nas diversas decisoes pre-constituintes que conduziram a formulacao das sucessivas Constituicoes portuguesas, a saber: a Constituicao de 1822, a Carta Constitucional de 1826, a Constituicao de 1838, a Constituicao de 1911, a Constituicao de 1933 e a atual Constituicao de 1976. Concomitantemente abordarei aquilo a que Peter Badura designou de “Leitbildfunktion der Verfassung”, ou seja, o modo como a Constituicao procura influenciar as geracoes futuras e o salutar desenvolvimento da comunidade politica atraves de linhas orientadoras e diretrizes. English Abtract: The Constitutional History allows to testify how the weight of the political and cultural history of each State decisively influences the design of its constitutional order. In this context, I propose to discuss, on the one hand, the important role that historical contingencies have had in the various pre-constitutional decisions that led to the formulation of the several Portuguese Constitutions, namely: the Constitution of 1822, the Constitutional Charter of 1826, the Constitution of 1838, the Constitution of 1911, the Constitution of 1933, and the present Constitution of 1976. At the same time I will address what Peter Badura called the Leitbildfunktion der Verfassung, ie how the Constitution seeks to influence future generations and the development of the political community.
