O presente artigo tem por objeto examinar o tema referente ao direito de antena no Brasil sob o viés da sociedade da informação em um Estado Democrático de Direito e como um dos fundamentos que estruturam constitucionalmente a República Federativa do Brasil. Para o cumprimento da análise temática parte-se do escorço histórico referente ao direito de antena, observando-se através de sua análise conceitual que possui natureza de direito ambiental e as consequências daí derivadas. Para além disso, examina-se a íntima ligação existente entre o direito de antena e o direito ao acesso à comunicação e à informação. Palavras-chave : direito de antena; espectro eletromagnético; bem ambiental; direito à informação ABSTRACT This article has the purpose to analyze the topic concerning to broadcasting rights in Brasil, under the bias of the information society in a democratic state of law and as one of the foundations that structure constitutionally the Federative Republic of Brasil. In order to perform the thematic analysis, the historical foreshortening part relating to antenna (broadcasting) rights, focusing up through its conceptual analysis that has nature of environmental law and consequences derived from them. In addition, it examines the intimate connection between the right to broadcast and the right of access to communication and information.
