Portuguese Abstract: A crescente integracao internacional entre os Estados levou a criacao daquilo que se chama de tutela multinivel dos direitos fundamentais. Na Europa tal tutela ocorre por meio da protecao dos direitos fundamentais nao apenas pelas Constituicoes dos Estados europeus, mas tambem pela Carta dos Direitos Fundamentais da Uniao Europeia e pela Convencao Europeia dos Direitos do Homem. Entretanto, a existencia de varias instâncias protetivas nao leva automaticamente a maior protecao dos direitos fundamentais dos cidadaos. Analisa-se neste sentido o caso Melloni, em que o Tribunal de Justica da Uniao Europeia acabou por rebaixar o nivel de protecao dos direitos fundamentais de um cidadao italiano. Para atingir tal objetivo o texto apresenta inicialmente o conceito de tutela multinivel dos direitos fundamentais; em seguida analisam-se alguns dos riscos envolvidos em tal tutela; e por fim faz-se uma analise do caso Melloni, mostrando como ocorreu o rebaixamento do nivel de protecao. English Abstract: Increasing international integration among states has led to the creation of what is called multilevel protection of fundamental rights. In Europe, such protection takes place through the protection of fundamental rights not only by the Constitutions of European States, but also by the Charter of Fundamental Rights of the European Union and by the European Convention on Human Rights. However, the existence of several protective instances does not automatically lead to greater protection of citizens’ fundamental rights. The Melloni case, in which the Court of Justice of the European Union has finally lowered the level of protection of the fundamental rights of an Italian citizen, is here analyzed. To achieve this objective, the text initially presents the concept of multi-level protection of fundamental rights; then some of the risks involved in such protection are analyzed; and finally an analysis of the Melloni case is made, showing how the lowering of the level of protection occurred.
