Resumo : O presente trabalho versa sobre o ativismo judicial, o qual esta tendo um grande avanco entre os poderes que regem o Estado. E apresentado sob a forma de artigo atendendo a requisito obrigatorio para a obtencao do grau de Bacharel em Direito pela UNIARP – Universidade Alto Vale do Rio do Peixe. Para melhor compreensao, como resultado da pesquisa, o relato e dividido em tres itens. Na primeira parte sera abordada a teoria de Montesquieu acerca da separacao dos poderes com analise junto ao sistema de freios e contrapesos. Em um segundo momento, o estudo apontara sobre a atuacao de cada poder estatal. No terceiro item, relata-se a respeito da atuacao do judiciario em meio ao outros poderes. O estudo faz uso do metodo indutivo associado a pesquisa bibliografica utilizando a producao descritiva e observando a Normalizacao dos Trabalhos Academicos da Universidade Alto Vale do Rio do Peixe (UNIARP) e regras da Associacao Brasileira de Normas Tecnicas (ABNT). JUDICIAL ACTIVISM AND ITS LIMITS IN THE NATIONAL LEGAL SCENARIO Abstract: This paper deals with the judicial activism, which is having a breakthrough between the powers governing the state. It is presented in the form of article serving mandatory requirement for the degree of Bachelor of Law from UNIARP - University Alto Vale do Rio do Peixe. For better understanding, as a result of the research, the report is divided into three items. In the first part will be addressed to Montesquieu's theory of separation of powers analysis along with the system of checks and balances. In a second phase, the study will point about the performance of each state power. The third item is reported about the judicial practice among the other powers. The study makes use of the inductive method associated with the bibliographic research using descriptive production and observing the Standardization of Academic University Alto Rio do Peixe Valley (UNIARP) and rules of the Brazilian Association of Technical Standards (ABNT).
