Spanish Abstract: El articulo analiza desde la perspectiva del Estatuto de la Corte Penal Internacional, la muerte del reportero espanol Jose Couso Permuy el 8 de abril de 2003. Mientras el senor Couso filmaba desde la habitacion 1403 del Hotel Palestina in Baghdag (Iraq), fue asesinado por un proyectil disparado desde un tanque M1 Abrams por el Batallon Tercero de Infanteria del Ejercito de los Estados Unidos que estaba entrando en Baghag. La reflexion que se hace en este texto a la luz del caso Couso muestra los obstaculos jurisdiccionales y procedimentales, asi como los problemas derivados de la aplicacion del principio de complementariedad y el test de gravedad, trayendo asi casos de crimenes de guerra aislados que tiene que ser tratados. English Abstract: The article analyzes from the perspective of the Statute of the International Criminal Court the death of the Spanish reporter, Jose Couso Permuy on 8 April 2003. While Mr. Couso was filming from room 1403 of the Hotel Palestina in Baghdag (Iraq), he was killed by a projectile fired from an M1 Abrams tank of the Third Infantry Battallion of the US Army which was entering Baghdag. The reflections made in this piece in the light of the Couso case show the jurisdictional and procedural obstacles, as well as those issues derived from the application of the principle of complementarity and the gravity threshold, which those bringing to the ICC isolated war crimes cases will have to deal with.
