A tutela da confiança em face dos comportamentos contraditórios (The Protection of Trust Against Contradictory Behaviors)

ResumoPortuguese Abstract: Com a modificacao do paradigma voluntarista desenvolvido sob a egide do liberalismo, a base do negocio juridico alcancou uma vertente objetiva, a qual assegurou o surgimento de inumeros mecanismos de controle da autonomia privada. Dentre esses institutos, e possivel apontar a relevância de alguns deles revigorados pelo Direito Romano, cuja elevada carga etica denota uma de suas maiores virtudes no controle do exercicio de direitos subjetivos. A teoria dos atos proprios, engendrada no brocardo venire contra factum proprium, consubstancia um dos institutos oriundos do Direito Romano que se notabilizou pela tutela da relacao de confianca advinda de comportamentos propensos a despertar legitimas expectativas. O cerne da teoria dos atos proprios reside, pois, na proibicao de comportamentos contraditorios em face de manifestacoes de vontade anteriores. English Abstract: With the changes in the paradigm of voluntarism developed under the protection of liberalism, the bases for legal acts have reached an objective dimension, resulting in the birth of a number of mechanisms of control of private autonomy. Among these mechanisms, we can point out the relevance of those reinforced by the Roman Law, whose high ethical value underlines one of its biggest virtues in the control of the exercise of subjective rights. The prohibition of inconsistent behavior, conceived in the term venire contra factum proprium, constitutes one of the concepts from the Roman Law renown for the protection of the trust relationship drawn from behaviors inclined to arouse legitimate expectations. The kernel of the prohibition of inconsistent behavior, therefore, lies in the prohibition of conflicting behaviors against previous manifestations of will.
