EnglishThis paper aims to analyze, inside a history of legal thought, Roberto Lyra’s conception of criminal law teaching. How did Lyra deal with the 19th century “bachareilismo” tradition, very rethorical and encyclopedic? Even though there already is some historiography regarding correlate topics from those here (“bacharelismo”, Brazilian criminal law science, etc.), there is still a gap in the history of ideas of the one who is probably, for this lapse of time (c. 1930’s to 1950’s), one of the legal scholars Who wrote the most about the teaching of criminal law. Beginnig with Lyra’s most important texts on the topic (and correlates), as well as those of its discussants (such as Nelson Hungria), and the distinction between scientific knowledge and school knowledge (as used in some didatics theories and education historiography), it was possible to identify, in lyrian thought, a clash, at school knowledge level, against “bacharelismo”’s rethoric and enciclopedical tradition, in the name of ideas similar of those defended by tecnicist conception of criminal law science, but having as consequence the liberation of criminal law science from the statutory law of the same tecnicist conception, which tended to see the legal science as a simple aide in application of state statutes. portuguesO objetivo deste artigo e compreender, no âmbito de uma historia do pensamento juridico, a concepcao de ensino do direito penal de Roberto Lyra. Como Lyra lidava com a tradicao bachaleresca oitocentista fortemente enciclopedica e retorica? Muito embora ja exista historiografia juridica sobre varios temas correlatos aquele aqui proposto (bacharelismo, ciencia juridico-penal no Brasil etc.), ainda existe uma lacuna no que diz respeito a historia das ideias daquele que, provavelmente, para o periodo em questao (aproximadamente dos anos 1930 ate os anos 1950), foi um dos juristas que mais escreveu sobre ensino do direito penal. Partindo dos textos mais importantes de Lyra sobre o assunto (e correlatos), bem como daqueles dos seus principais interlocutores (como Nelson Hungria), e da distincao entre saber cientifico e saber escolar proveniente da didatica e da historiografia da educacao, foi possivel surpreender, no pensamento lyriano, um embate, no plano do saber escolar, contra a tradicao retorica e enciclopedica do bacharelismo em nome de ideias semelhantes aquelas propugnadas pela concepcao de ciencia juridico-penal tecnicista, mas com a consequencia de libertar a ciencia juridico-penal das amarras legais desse mesmo tecnicismo, que tendia a ver na ciencia juridica um mero aporte para a aplicacao das leis estatais.
