Resumo

This essay examines the case on Obligations Concerning Negotiations Relating to Cessation of the Nuclear Race and to Nuclear Disarmament, decided by the International Court of Justice in 2016.Although it has not been allowed to proceed to the merits stage, I argue that this case is significant for setting up a new threshold for admittance of a case in Court.This essay criticizes the judgment taking into account its internal coherence, the positive law applicable to determination of ICJ's jurisdiction, and relevant precedents.It concludes that the Court stepped away from its jurisprudence whilst delivering a decision that runs against access to justice.
