DOI: 10.1590/2179-8966/2020/47403 Abstract The United Nations Convention on the Rights of Persons with Disabilities (CRPD) was the first treaty to be incorporated as a Constitutional law, according to the determination of the Brazilian Constitution for human rights treaties. In addition, the Optional Protocol was also promulgated, recognizing the competence of the Committee on the Rights of Persons with Disabilities to supervise the application of the treaty in Brazil. This study aims to analyze the impact of the Committee and Convention in Brazilian courts, specifically in the courts that have jurisdiction to rule on cases based on treaties, that is, the Federal Justice. An extensive survey of judicial decisions was carried out in order to verify whether the protections of the treaty are applied. This research focus on the efforts to ensure the rights of persons with disabilities on the Brazilian legal system, based on the commitment to international cooperation to guarantee and promote the rights and principles announced in the CRPD, particularly regarding the social model of disability, which is the main protective concept used in the treaty. Resumo A Convencao sobre os Direitos das Pessoas com Deficiencia da ONU (CDPD) foi o primeiro tratado a ser incorporado como uma Lei Constitucional, de acordo com a determinacao da Constituicao Brasileira para os tratados de direitos humanos. Alem disso, o Protocolo Facultativo tambem foi promulgado, reconhecendo a competencia do Comite dos Direitos das Pessoas com Deficiencia para supervisionar a aplicacao do tratado no Brasil. Este estudo tem como objetivo analisar o impacto do Comite e da Convencao nos tribunais brasileiros, especificamente nos tribunais que tem competencia para julgar casos com base em tratados, ou seja, a Justica Federal. Foi realizado um amplo levantamento das decisoes judiciais para verificar se as protecoes do tratado sao aplicadas. Esta pesquisa tem foco nos esforcos para a garantia dos direitos das pessoas com deficiencia no ordenamento juridico brasileiro, com base no compromisso de cooperacao internacional para garantir e promover os direitos e principios anunciados na CDPD, em particular no que se refere ao modelo social da deficiencia, que e o principal conceito protetivo utilizado no tratado.
