La cuestion de si la teoria juridica del delito debe estructurarse en dos o tres grandes categorias se ha venido vinculando con la de la viabilidad de la Teoria de los elementos negativos del tipo (TENT). En este articulo, sin embargo, se argumenta que tal asimilacion es conceptualmente erronea (ya que la estructuracion bipartita puede defenderse sin necesidad de aceptar la TENT) e historicamente problematica (ya que la historia de la TENT es un excelente ejemplo de como no debe defenderse o criticarse una teoria). Die Frage um die zweioder dreistufige Deliktsaufbau ist historisch mit der Vertretbarkeit der Lehre von den negativen Tatbestandsmerkmalen verbunden worden. In diesem Aufsatz wird argumentiert dass solche Verbindung sowohl Theoretisch falsch (da die zweistufige Strukturierung ohne Rekurs auf die Lehre von den negativen Tatbestandsmerkmalen begrundet werden kann) als auch historisch problematisch ist (weil die historische Entwicklung der Lehre von den negativen Tatbestandsmerkmalen ein besonders gut Beispiel dazu ist, wie man eine Theorie nicht verteidigen oder kritisieren soll). Should criminal law theory be structured in a bipartite or in a tripartite fashion?
