Resumo O presente artigo destina-se a estudar hermeneutica da ciencia social, que fundamenta os direitos basicos previstos na Constituicao Federal do Brasil de 1988, e busca compreender as controversias das argumentacoes doutrinarias que se intensificaram no Brasil diante do combate a pandemia da Covid-19. Nesse intento, resolveu-se partir da analise da teoria do garantismo penal de Ferrajoli, na finalidade de analisar concepcoes dos principios fundamentais que sustentam a sociedade (genese do principio da supremacia do interesse publico sobre o privado). Para isso, utilizam-se o metodo de abordagem comparativa, e historicas por analise de dados bibliograficos, buscando constatar se os pensamentos reducionistas podem causar inseguranca juridica no Brasil. Abstract The present scientific work aims to study the hermeneutics of social science, which underlies the basic rights provided in the Constitution of the Federative Republic of Brazil (1988), and seeks to understand the controversies of the doctrinal arguments that have intensified in Brazil to fight against the Covid-19 pandemic. In this sense, it was decided from the analysis of Ferrajoli's theory of penal guarantee, in order to reflect conceptions of the fundamental principles that sustain society (genesis of the supremacy of the public interest over the private principle). For this, was used the comparative methods and historical approach by bibliographic analyzing, to verify if the reductionist thoughts can cause judicial insecurity in Brazil.
