DOI: 10.1590/2179-8966/2020/ 49443 Resumo O artigo reflete sobre o rompimento do pacto de silenciamento em torno da resistencia quilombola promovido a partir da Constituicao de 1988. Para tanto, considerando que o Direito Constitucional demorou um seculo para reconhecer a resistencia quilombola (1888 a 1988), parte do dispositivo previsto no art. 216, § 5o, da Constituicao brasileira, para indagar a importância de se estudar a patrimonialidade dos sitios detentores de reminiscencias historicas dos antigos quilombos e as suas implicacoes no campo juridico. A metodologia consistiu na revisao critica de literatura. Palavras-chave : Constitucionalismo ; Silencios ; Quilombos ; Inclusao ; Igualdade. Abstract The article reflects on the rupture of the silence pact about the quilombola issue enhanced after the Constitution of 1988 . To this end, considering that Constitutional Law took a century to recognize the legitimacy of the quilombola resistance (1888 to 1988), we start with the provision in art. 216, § 5, of the Brazilian Constitution, to inquire about the importance of studying the cultural heritage of sites that have historical reminiscences of the old quilombos and their implications in the legal field.
