Função Social da Hermenêutica (Social Role of Hermeneutics)

ResumoEnglish Abstract:: This article is part of book written in honor of Prof. Tercio Sampaio Ferraz Jr. for the 40th anniversary of the publication of his work Introducao ao Estudo do Direito - Tecnica, Decisao, Dominacao (Introduction to Law - Technique, Decision, Domination). The book written in homage to the professor follows the same chapters and topics of the original work. Each of these items was critically approached by Brazilian jurist (in total, there are 19 contributors). In the topic Role of Hermeneutics, Tercio Sampaio Ferraz Jr. conceptualizes legal hermeneutics as a way of thinking dogmatically the Law, which allows control of the possible consequences of its incidence on reality before they occur. The hermeneutic methods are then responsible for the identification of the meaning of the normative text applicable to reality. At this point, Ferraz Jr. raises the question of the legitimacy of the interpretation attributed to legal norms, referring to one of the most important authors in Sociology, Pierre Bourdieu, and his concept of symbolic violence. Linking Law to symbolic violence, Ferraz Jr. states that, by harmonically regulating social conflicts, Law removes their concreteness, transforming them into abstract conflicts, neutralizing the social tension effectively involved, and thus functioning as an instrument of cultural domination. Social inequality and legitimacy of the legal system are thus presented as antithetical realities. Therefore, the transformation of the social order demands the development of strategy for the accumulation of cultural capital. Only by increasing this capital, it is possible to increase access to the formation, interpretation, and application of the legal order. A corollary of the expansion of this access is then the transformation of Law from an instrument of domination into an indispensable structure for guaranteeing the civilizing process, insofar as it is an essential resource for protecting the political and legal conquests achieved in the social sphere. Portuguese Abstract:Este artigo consta de livro escrito em homenagem ao Prof. Tercio Sampaio Ferraz Jr. pelos 40 anos da publicacao de sua obra Introducao ao Estudo do Direito - Tecnica, Decisao, Dominacao. O livro elaborado em homenagem ao professor segue os mesmos capitulos e topicos da obra original, tendo sido cada um desses itens abordado criticamente por um jurista brasileiro (no total, sao 19 colaboradores). No topico Funcao Social da Hermeneutica, Tercio Sampaio Ferraz Jr. conceitua hermeneutica juridica como “uma forma de pensar dogmaticamente o Direito que permite um controle das consequencias possiveis de sua incidencia sobre realidade antes que elas ocorram”. Os cânones hermeneuticos sao entao responsaveis pela identificacao do sentido do texto normativo aplicavel aquela realidade. Ferraz Jr. coloca nesse momento pergunta pela legitimidade da interpretacao atribuida norma, remetendo um dos autores de maior folego na Sociologia, Pierre Bourdieu e o seu conceito de violencia simbolica. Associando Direito violencia simbolica, Ferraz Jr. afirma que, ao normatizar harmonicamente os conflitos sociais, o Direito retira-lhes concretude, transformando-os em conflitos abstratos, neutralizando tensao social efetivamente envolvida, e funcionando assim como instrumento de dominacao cultural. Desigualdade social e legitimidade do sistema juridico apresentam-se, entao, como realidades antiteticas. Por conseguinte, transformacao da ordem social demanda o desenvolvimento de estrategia de acumulacao do capital cultural. Somente com o aumento desse capital e possivel incrementar o acesso formacao, interpretacao e aplicacao da ordem juridica. Corolario da ampliacao desse acesso e entao transformacao do Direito de instrumento de dominacao em estrutura indispensavel garantia do processo civilizatorio, na medida em que recurso essencial protecao das conquistas politicas e juridicas alcancadas na esfera social.
