Resumo

In a reasoned order, the Court of Justice of the European Union (CJEU) ruled that the concept of ‘communication to the public’ within the meaning of Article 3(1) of Directive 2001/29 (the ‘InfoSoc Directive’) must be interpreted as encompassing the transmission in a cafe-restaurant of works broadcasted via a radio device plugged to speakers and/or amplifiers (Sociedade Portuguesa de Autores CRL, C-151/15, EU:C:2015:468).
