'Guerra Civil': Precisamos De Super-Heróis? ('Civil War': Do We Need Superheroes?)

ResumoPortuguese Abstract: O cinema e um dos elementos centrais da “cultura pop” na atualidade, com destaque para os filmes de super-herois. Neste contexto o Marvel Studios lancou em 2016 o filme “Capitao America: Guerra Civil”, o qual traz como pano de fundo o seguinte questionamento: devem os super-herois agirem livremente ou devem ser supervisionados por alguma agencia governamental? O questionamento e relevante para o âmbito juridico no que diz respeito a atuacao verificada, em tempos recentes, pelas inumeras instâncias dos tribunais brasileiros, atuacao esta que, se desmedida, leva ao chamado “ativismo judicial” – de maneira que o magistrado acabe por se apresentar, em ultima instância, como um “super-heroi” para a sociedade brasileira. Busca-se, neste artigo, mostrar que este ativismo judicial e perigoso, especialmente para sociedades tais quais a brasileira que acabam por aceitar o surgimento de “salvadores da patria”, o que leva, em ultima instância, a fragilizacao da propria nocao de Estado democratico de direito. O artigo se divide em tres partes: na primeira apresenta-se, de maneira breve, a relacao entre Direito e cinema com base no filme “Capitao America: Guerra Civil”; na segunda o artigo traz, como estudo de caso, o habeas corpus 126.292, do Supremo Tribunal Federal, que relativizou o principio da presuncao da inocencia; por fim, sao feitos apontamentos sobre as consequencias do ativismo judicial para a sociedade brasileira. O artigo se fundamenta no metodo indutivo e usa como tecnica de pesquisa a bibliografica, sendo fundamentado no proprio texto legal, bem como em jurisprudencia e em doutrina brasileira e estrangeira. English Abstract: Movies are one of the central elements of today’s popular culture, especially superhero films. In this context Marvel Studios released in 2016 the film “Captain America: Civil War”, which brings in its background the following question: should superheroes act freely or should they be supervised by a government agency? The question is relevant in the Brazilian legal context due to the alleged excessive action, in recent times, by numerous instances of Brazilian courts, leading to the so-called “judicial activism” – so that the magistrate will eventually present himself or herself, ultimately, as a “superhero” to the Brazilian society. It is aimed, in this article, to show that this judicial activism is dangerous, especially for societies such as the Brazilian one which end up accepting the emergence of so-called “saviors of the nation”, so that this leads, ultimately, to the weakening of the notion of democratic rule of law. To achieve this objective, the article is divided into three parts: the first presents briefly the relationship between law and movies based on the film “Captain America: Civil War”; the second brings as a case study the habeas corpus 126,292 from Brazilian Supreme Court, which relativized the principle of presumption of innocence; finally, notes are made on the consequences of judicial activism for Brazilian society. The article is based on the inductive method and uses a bibliographic research technique, being based on legal texts as well as in jurisprudence and in Brazilian and foreign doctrine.
