Resumo

Spanish Abstract: En este articulo hemos analizado unas alegaciones formuladas en la prime- ra mitad del siglo XVII, que pertenecen al genero literario forense de las alega- ciones e informaciones en Derecho o porcones. Ellas nos han permitido aproxi- marnos a la actividad en los tribunales de su autor, la faceta mas desconocida del jurista e historiador granadino Francisco Bermudez de Pedraza. Se trata de un pleito dirimido en la Chancilleria de Granada, respecto al mayorazgo de Valen- zuela, instituido en 1380. Controversia en la que el defendido de Pedraza, Pedro Fernandez de Valenzuela, reclama la posesion de el, tras permanecer durante mas de dos siglos en la rama considerada usurpadora, la de Diego Paez de Cas- tillejo y Valenzuela. El jurista fundamenta esta reclamacion en tres cuestiones: el albala del rey Juan de Castilla, la no prescripcion del derecho al mayorazgo y la filiacion English Abstract: In this article, we have analyzed some alegations formed in the first half of the XVII century that belong to the literary genere of porcones. They have enabled us to understand what happened in the tribunals of the autor, the most unknown aspect of the granadino lawyer and historian Francisco Bermudez de Pedraza. It’s about a dispute settled in the Chancilleria de Granada about the inheritance of the eldest son of Valenzuela family, which occured in 1380. Controversially in which the defendent of Pedraza, Pedro Fernandez de Valenzuela, claimed his inheritance from the usurper Diego Paez de Castillejo y Valenzuela, after being part of the family for more tan two centuries. The lawyer’s claim was base don three areas: the validity of the first primogeniture opposite to the second one, the lack of the rights of the eldest son to inherit and his descendents
