ResumoThis article consists of an analysis of the delimitation of the protection area of the historic district of the city of Tiradentes - Minas Gerais, Brazil - and its relationship with environmental preservation, especially with regard to the process of protecting the Serra de Sao Jose. The environmental preservation area of Serra de Sao Jose and the historic district of Tiradentes arose several conflicts under the aegis of the dichotomy between environmental preservation and cultural heritage x urban development. These conflicts result in the adoption of illegal strategies and practices carried out on Sundays and holidays when there is no inspection. Analyzing the meaning of the cultural heritage protection act and the processes that led to the application of this instrument, in the said heroic phase of the National Historical and Artistic Heritage Service (Sphan), is fundamental for an understanding of the delimitation of the protection areas. When selecting what to preserve and what to “forget”, Sphan revealed the concept of heritage in force at the time, making it possible to question the reasons that could have led Serra de Sao Jose to not be included in the city's initial protection plan.
