Estonian Abstract: Saatesonas Harti „Oiguse moiste” eestikeelsele valjaandele pakun sisulise ulevaate viimastest aregusuundadest Harti algatatud aruteludes oiguse olemuse (sh. oiguse jargimise kohustuse olemuse ja ka oiguse ning moraali omavahelise suhte) ule. Selgitan, milles seisneb mitmete kaasaegsete autorite tahelepanekute pohisisu ja millised on olnud Harti teooria edasiarendused. Tasub tahele panna, et hoolimata Harti valikust anda oma teosele pealkirjaks „Oiguse moiste”, toob autor lugejateni pigem analuusi oiguse olemusest kui selle moistest. Harti analuusi uurimisobjektiks pole moiste ise, vaid see, mida moiste holmab. Nii on ka saatesona pohiteemaks oiguse olemus ja seda kasitlevad debatid. English Abstract: introduction to the Estonian edition of Hart’s Concept of Law offers a substantive overview of the most recent developments in the debates that Hart inspired on the nature of law, the nature of obligation to obey the law and law’s relationship with morality. While Hart called his book The Concept of Law, what he actually proposes is an analysis of the nature of law, rather than the concept, as Joseph Raz has pointed out. Accordingly, the object of my analysis is not the concept but the entities that fall under the concept. The original publication of the Concept of Law brought along a new era in legal philosophy. It presents one of the most influential accounts of legal positivism until today and is considered the most important text in the legal philosophy of the 20th century. I attempt to inspire the reader to get involved in these debates showing how jurisprudence is full of intriguing disagreements. disagreements regarding the concept of law and legality form the core of legal philosophy and just like disagreements in general help to reveal the central features of a particular subject, so do the debates about the nature of law. They tell us what law really is.
