Sports Broadcasting Issue in India: Mandatory Sharing with Prasar Bharati

ResumoThis paper aims to research the interface between broadcasting and sports scenarios particularly focusing on the Prasar Bharti issue. The paper starts by tracing the history back to the first step when the court held that airwaves are not independent property and should be used in the ‘public interest’. Later, with the enacting of the Mandatory Sharing Act, the whole playground was made unfair with the Government pretty much snatching away the waves in the name of ‘public interest’ and ‘matches of national importance’. Hence the researcher intends to look into the endemic problem which traumatises the Indian situation which also makes it different from other jurisdictions with similar issue.The interface between sports and media is indeed interesting to this aspect and the researcher resolves to give possible solutions to the contention that the present setup does no fully cover ‘public interest’ in a whole because a group of people are left out from the viewership. There are plenty of other better options envisaged by other jurisdictions which are analysed to guide India to change its setup so as to better serve the people and also remove this confusion of mandatory sharing and parallel broadcast. The researcher will critically be analysing the various other cases which have arisen due to this mandatory sharing with Prasar Bharati and thereby try to resolve the larger problem.
