O objetivo deste artigo é analisar como se dá a dualidade do Estado no contexto neoliberal ao executar políticas ambientais. A metodologia se deu a partir da pesquisa bibliográfica com a abordagem qualitativa. Os resultados da pesquisa indicaram que a Constituição Federal de 1988 inova quando preconiza um Estado democrático de direito em garantir o bem-estar dos cidadãos na defesa e preservação do meio ambiente. Contudo, a ação do Estado ao estimular o crescimento econô­mico sob diferentes formas produz, inevitavelmente, uma diversidade de impactos ambientais negativos que são transferidos para toda a sociedade na geração da pobreza, desigualdade, exclusão social, restrições e retrocessos aos princípios da cidadania, privatização do patrimônio público social e natural e ampliação da externalidade ambiental. Por outro lado, cabe a esse mesmo Estado fazer a regulação, o controle e a gestão ambiental como garantia da própria reprodução do sistema econômico, político e social. Além disso, gerenciando os conflitos de interesses entre grupos concorrentes e respondendo às demandas dos movimentos sociais como tarefa de legitimação da ordem constituída. Sob guia de conclusão, ressaltamos que mesmo diante desse caráter duplo de intervenção, o Estado se apresenta fortemente ao atender a interesses particulares, evidenciando, em alguns momentos, seu compromisso e sua subordinação à classe dominante. ABSTRACT The objective of this article is to analyze the duality of the State in the neoliberal context when executing environmental policies. The methodology was based on bibliographical research with a qualitative approach. The results of the research indicated that the Federal Constitution of 1988 innovates when it advocates a democratic State of law to guarantee the well-being of citizens in the defense and preservation of the environment. However, the action of the State in stimulating economic growth in different forms inevitably produces a diversity of negative environmental impacts that are transferred to society as a whole, generating poverty, inequality, social exclusion, restrictions and setbacks to the principles of citizenship, privatization of the social and natural public patrimony, and the expansion of environmental externalities. On the other hand, it is up to this same State to regulate, control and manage the environment as a guarantee of the very reproduction of the economic, political and social systems. Moreover, it has to manage conflicts of interest between competing groups and respond to the demands of social movements as a task of legitimizing the constituted order. By way of conclusion, we emphasize that even in the face of this dual character of intervention, the State presents itself as strongly serving particular interests, evidencing, at times, its commitment and subordination to the dominant class.
