Os Desafios da Regulamentação da Inteligência Artificial (IA) no Brasil em Relação a Alguns Países Desenvolvidos

Os países desenvolvidos estão céleres quanto à necessidade de regulamentação e implementação da Inteligência Artificial, visto que ela é a tecnologia de propósito geral do século XXI e que, embora estejam confiantes que a IA apresentará uma expressiva contribuição no crescimento econômico do país, promoverá, também, altos riscos à sociedade, caso não haja uma regulamentação clara, abrangente e segura. O objetivo deste artigo é o de pesquisar e analisar o andamento da regulamentação da Inteligência Artificial em países desenvolvidos, com o intuito de comparar com a atual situação brasileira, buscando entender quais os desafios da regulamentação da IA no Brasil em relação a alguns países desenvolvidos. A metodologia foi baseada em pesquisas bibliográficas, tais como: livros, artigos, sites especializados, trabalhos de conclusão de curso, jornais, Projetos de Lei da Câmara dos Deputados e do Senado Federal brasileiro. Entre os resultados obtidos, notou-se que o Brasil parece está atrasado quanto à regulamentação e orientação da IA em relação ao Japão, EUA e ao Reino Unido, e que ainda há diversos desafios que precisam ser superados, como, por exemplo, compreensão adequada acerca de vários aspéctos da IA, a falta de parâmetros para o controle da qualidade dos dados e não saber se é melhor uma regulação setorial para que seja possível alcançar uma estratégia nacional de IA bem regulamentada, na qual a criação de novos modelos de negócios e de novas tecnologias sejam de maneira sustentável e harmônica com os direitos fundamentais dos cidadãos. Abstract Developed countries are quick to respond to the need for regulation and implementation of Artificial Intelligence, given that it is the general-purpose technology of the 21st century and that, although they are confident that AI will make a significant contribution to the country's economic growth, it will promote also high risks for society if there is no clear, comprehensive and safe regulation. The objective of this article is to research and analyze the progress of Artificial Intelligence regulation in developed countries with the aim of comparing it with the current Brazilian situation, seeking to understand the challenges of AI regulation in Brazil in relation to some developed countries. The methodology was based on bibliographical research such as: books, articles, specialized websites, course completion works, newspapers, Bills from the Chamber of Deputies and the Brazilian Federal Senate. Among the results obtained, it was noted that Brazil seems to be lagging behind in AI regulation and guidance in relation to Japan, the USA and the United Kingdom and that there are still several challenges that need to be overcome, such as, for example, adequate understanding of various aspects of AI, the lack of parameters for data quality control and not knowing whether sectoral regulation is better so that it is possible to achieve a well-regulated national AI strategy, where the creation of new business models and new technologies are sustainable and harmonious with the fundamental rights of citizens.
