A decifracao do codigo genetico e o desenvolvimento da engenharia genetica permitem ao homem, pela primeira vez, intervir diretamente na essencia da vida, provocando uma reacao da sociedade aos riscos associados as incertezas cientificas e tecnologicas, projetadas nas esferas juridica e etica. No Brasil, tanto o progresso da biotecnologia moderna quanto o debate etico e juridico a ele associado, embora ainda recentes, vem sendo estimulados, a partir do inicio desta decada, pela expansao da pesquisa e pela correspondente regulacao legal. Este artigo examina a legislacao brasileira concernente a propriedade intelectual aplicada a biotecnologia moderna, notadamente patentes e protecao de cultivares, bem como aspectos relativos a propriedade intelectual na Convencao sobre Diversidade Biologica, firmada durante a UNCED, no Rio de Janeiro em 1992, e sua regulacao atraves do Projeto de Lei de Acesso a Recursos Geneticos. THE INTELLECTUAL PROPERTY RIGHTS AND BIOTECHNOLOGY ABSTRACT The decipherment of the genetic code and the development of genetic engineering have enabled man to directly intervene, for the first time, in the very essence of life. Society reacts against the risks derived from scientific and technological uncertainties, which are projected into the juridical and ethical spheres. In Brazil, both the development of modern biotechnology, and the correspondent ethical and juridical debate have been stimulated since the beginning of this decade by the recent expansion of research and its growing legal regulation. The present article examines the Brazilian legislation concerning intellectual property related to the modern biotechnology, specially patents and protection of cultivars, as well as the Convention on Biological Diversity, signed during the UNCED, in Rio de Janeiro in 1992, and its regulations through the Brazilian Bill of Law on Access to Genetic Resources.
